1. Introduction and Acceptance of Terms

Welcome to Pawla, the social networking application for dog owners and enthusiasts ("the App" or "Pawla"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and DIJI TECHNOLOGY LTD ("Company", "we", "us", or "our").

By downloading, installing, accessing, or using Pawla, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App and should uninstall it immediately.
These Terms apply to all users of the App, including visitors, registered users, and contributors of content. Your use of the App constitutes acceptance of these Terms and your agreement to comply with all applicable laws and regulations.

3. Eligibility and Age Requirements

To use Pawla, you must:
• Be at least 16 years of age. Users under 16 may only use the App with the express consent and supervision of a parent or legal guardian
• Have the legal capacity to enter into binding agreements in your jurisdiction
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Own, foster, care for a dog, or be a genuine dog enthusiast
• Not be prohibited from using the App under applicable laws
We reserve the right to verify your age and identity at any time. If you are found to be ineligible, we may immediately suspend or terminate your account without notice.



4. User Registration and Account Security

To access certain features of Pawla, you must create an account. When registering, you agree to:
• Provide accurate, truthful, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with any third party
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activities that occur under your account
You are solely responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account, whether authorised by you or not. We are not liable for any loss or damage arising from your failure to comply with these security obligations.
We reserve the right to suspend or terminate accounts that are inactive for extended periods or that violate these Terms.


5. User Conduct and Responsibilities

You agree to use Pawla only for lawful purposes and in accordance with these Terms. You agree NOT to:
• Harass, threaten, intimidate, or harm other users or their dogs
• Post false, misleading, or fraudulent information
• Use the App for any commercial purpose without our prior written consent
• Spam, send unsolicited messages, or engage in any form of automated data collection
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or violates others' rights
• Violate any applicable local, national, or international laws or regulations
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorised access to the App, user accounts, or computer systems
You agree to:
• Treat all members with respect both online and in person
• Ensure your dog is safe, healthy, vaccinated, and properly supervised during meetups
• Pick up after your dog and follow all local park, public space, and leash laws
• Report any unsafe, suspicious, or inappropriate behaviour immediately
• Respect others' privacy and personal information
• Comply with all applicable laws regarding dog ownership and public spaces


6. Safety and Disclaimer of Liability

IMPORTANT SAFETY NOTICE:
Pawla acts solely as a platform to connect dog owners and enthusiasts. We do not:
• Vet, screen, background check, or verify the identity of users
• Inspect, verify, or guarantee the health, temperament, or behaviour of dogs
• Provide insurance coverage for users, dogs, or property
• Guarantee the safety or suitability of meetup locations
• Monitor or supervise in-person meetups
You acknowledge and agree that:
• All interactions, communications, and meetups arranged through Pawla are at your OWN RISK
• You are solely responsible for your own safety and the safety of your dog
• You should always meet in public places, inform others of your plans, and trust your instincts
• We are NOT liable for any injuries, damages, losses, or disputes arising from:

• In-person meetups or interactions

• Communications between users

• Dog-related incidents or injuries

• Property damage

• Any other activities related to your use of the App

We strongly recommend following our Community Guidelines and Safety Tips when using Pawla. You should exercise caution and good judgment when meeting other users in person.


7. Content Ownership and User-Generated Content

You retain ownership of all content you upload, post, or transmit through Pawla ("User Content"), including photos, text, messages, and profile information.
By uploading User Content, you grant DIJI TECHNOLOGY LTD a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable licence to:
• Use, reproduce, modify, adapt, and display your User Content within the App
• Use your User Content in promotional materials and marketing campaigns
• Share your User Content with other users as intended by the App's functionality
• Store and process your User Content on our servers
You represent and warrant that:
• You own or have the necessary rights to grant this licence
• Your User Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights)
• Your User Content does not violate any applicable laws
• You have obtained all necessary consents (including from people or pets appearing in photos)
We reserve the right to remove, edit, or refuse to post any User Content that violates these Terms, is offensive, harmful, spammy, or inappropriate, in our sole discretion. You can delete your User Content at any time, but this does not affect content already shared with other users or used in promotional materials.


8. Privacy and Data Protection

Your privacy is important to us. We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
What We Collect:
• Registration information (name, email, phone number)
• Profile information (photos, dog information, location area)
• Location data (approximate location for matching purposes)
• Usage data and app interactions
• Device information and technical data
How We Protect You:
• We implement appropriate technical and organisational measures to protect your data
• We never sell your personal data to third parties
• We limit data collection to what is necessary for App functionality
• We use encryption and secure storage methods
• We comply with all applicable data protection laws
• You have rights to access, correct, delete, or restrict your data
Exact addresses are never publicly displayed. We use approximate location data only to show nearby users and activities. You can adjust location permissions in your device settings at any time.

9. Location Services and Privacy

Pawla uses location-based services to help you connect with nearby dog owners and discover local activities.
Location Data Usage:
• We collect approximate location data (not exact addresses) to show nearby users and activities
• Location data is used solely for matching and activity discovery purposes
• Exact addresses are never publicly displayed or shared with other users
• You can disable location services in your device settings at any time
• Disabling location services may limit certain App features
Privacy Protections:
• We implement privacy-by-design principles
• Location data is anonymised where possible
• We do not track your exact movements or continuous location
• Location data is stored securely and in accordance with our Privacy Policy
• You can request deletion of location data by contacting us
You consent to the collection and use of location data as described in these Terms and our Privacy Policy.


10. Prohibited Activities

You are expressly prohibited from:
• Using the App for any illegal purpose or to violate any laws
• Harassing, stalking, or threatening other users
• Posting false or misleading information about yourself or your dog
• Creating fake or duplicate accounts
• Using automated systems to access the App (bots, scrapers, etc.)
• Attempting to reverse engineer, decompile, or hack the App
• Collecting user data without permission
• Using the App to promote commercial services without our consent
• Sharing other users' personal information without consent
• Impersonating any person, entity, or organisation
• Uploading viruses, malware, or malicious code
• Interfering with the App's security or functionality
• Violating any third-party rights (intellectual property, privacy, etc.)
Violation of these prohibitions may result in immediate account termination, legal action, and reporting to relevant authorities.


11. Intellectual Property Rights

The App and all its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, software, and designs) are owned by DIJI TECHNOLOGY LTD or its licensors and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to:
• Access and use the App for your personal, non-commercial use
• Download and install the App on your personal devices
You may NOT:
• Copy, modify, or distribute the App or its content
• Create derivative works based on the App
• Use our trademarks, logos, or branding without permission
• Remove or alter any copyright, trademark, or proprietary notices
• Use any automated means to access or use the App
All rights not expressly granted are reserved by DIJI TECHNOLOGY LTD.


12. Payment Terms and Premium Features

Currently, Pawla is offered as a free service. However, certain premium features may become available in the future (such as advanced filters, verified profiles, enhanced visibility, or event hosting capabilities).
If premium features are introduced:
• All purchases will be processed through official app stores (Apple App Store, Google Play Store)
• Prices will be clearly displayed before purchase
• Payment processing is subject to the app store's terms and conditions
• Subscriptions will automatically renew unless cancelled
• You can manage subscriptions through your app store account
• Refunds are subject to app store policies and UK consumer law
• We reserve the right to modify pricing with reasonable notice
DIJI TECHNOLOGY LTD is not responsible for payment processing issues that arise from app store policies or technical issues. Refund requests must be made through the appropriate app store in accordance with their policies.


13. Account Termination

You may terminate your account at any time by:
• Using the account deletion feature within the App settings
• Contacting us at support@pawla.app
Upon termination:
• Your account will be deactivated
• Your profile and User Content will be removed from public view
• Some information may be retained as required by law or for legitimate business purposes
• Your licence to use the App will immediately cease
We reserve the right to suspend or terminate your account immediately, without notice, if:
• You violate these Terms or our Community Guidelines
• You engage in harassment, unsafe behaviour, or illegal activities
• You create fake or misleading profiles
• You engage in fraudulent or deceptive practices
• You infringe upon others' rights
• We are required to do so by law
• Your account poses a security risk
We may also modify, suspend, or discontinue the App or any part of it, with or without notice, at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.


14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
DIJI TECHNOLOGY LTD, its officers, directors, employees, agents, and affiliates shall NOT be liable for:
• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Injuries, damages, or losses arising from:

• In-person meetups or interactions arranged through the App

• Dog-related incidents or injuries

• Communications between users

• Property damage

• Unauthorised access to or use of your account

• Any interruption or cessation of the App

• Bugs, errors, or technical malfunctions

• Third-party conduct or content

Our total liability to you for all claims arising from or related to your use of the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these Terms excludes or limits our liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited by law
You acknowledge that you use the App at your own risk and discretion.


15. Indemnification

You agree to indemnify, defend, and hold harmless DIJI TECHNOLOGY LTD, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
• Your use of or access to the App
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)
• Your User Content
• Your interactions with other users
• Any injuries or damages caused by you or your dog during meetups
• Your violation of any applicable laws or regulations
This indemnification obligation will survive the termination of these Terms and your use of the App.


16. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Dispute Resolution Process:

1. Informal Resolution: If you have a dispute with us, please contact us at support@pawla.app. We will attempt to resolve the dispute informally within 30 days.

2. Jurisdiction: If informal resolution is not successful, any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

You agree to waive any right to a jury trial in any dispute relating to these Terms or the App.


17. Changes to These Terms

We reserve the right to modify, update, or change these Terms at any time. When we make changes:
• We will update the "Last updated" date at the top of these Terms
• For material changes, we will notify you through:

• The App (push notifications or in-app messages)

• Email to your registered email address

• A prominent notice on our website or within the App

Your continued use of Pawla after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and delete your account.
We recommend reviewing these Terms periodically to stay informed of any updates. The most current version of the Terms will always be available in the App.


18. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of DIJI TECHNOLOGY LTD.


19. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and DIJI TECHNOLOGY LTD regarding your use of the App and supersede all prior agreements, understandings, or communications between you and us regarding the App.
If any conflict exists between these Terms and any other agreement or policy, these Terms shall prevail to the extent of the conflict.

Legal Notice

These Terms constitute a legally binding agreement between you and DIJI TECHNOLOGY LTD. These Terms are governed by the laws of England and Wales. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect. Your use of Pawla indicates your acceptance of these Terms and your agreement to comply with all applicable laws and regulations.
